Please carefully read the set out Online Shop Terms & Conditions of Use & Purchase below (including Sections 1 to 5 below).

When you purchase any goods, or services or book any event or conference using this Online Shop facility you will be required to tick a box to show that you agree to these terms & conditions.

Furthermore if you continue to browse & use this website you are agreeing to comply with, & be bound by, the following terms & conditions which will govern Oxford Brookes University’s (or its commercial subsidiary company Oxford Brookes Enterprises Limited) relationship with you.

The terms “the University” refers to Oxford Brookes University whose address is Headington Campus, Gipsy Lane, Headington, Oxford, OX3 0BP & “our” “us” or “we” or “Brookes” refers either to the University or “OBEL” (which means Oxford Brookes Enterprises Limited Co. Reg. No.  02299189, registered office address is Oxford Brookes University, Gipsy Lane, Oxford, OX3 0BP). The University reserves the right to deliver Goods or Services through any of its commercial subsidiary companies including OBEL.

The term “you” or “Customer” refers to any purchaser, user, or viewer of our Online Shop website.

 

Section 1 General Provisions

You agree that your use of this Online Shop website is subject to the following general terms & conditions of use:

1.1 You agree that our electronic acknowledgement of order/or electronic receipt & these terms & conditions constitute the entire agreement & understanding between us & you & no other communication shall form any part of this Agreement.

1.2 The contents of the Online Shop (including these terms & conditions) is subject to change by us without prior notice. We reserve the right to terminate your use of this website for any reason without notice.

1.3 Brookes’ rights against you under this Agreement are without prejudice to any other right or remedy of Brookes against you under this Agreement or in tort.

1.4 You are responsible for providing accurate & truthful information to us (where required) & you must not provide false or misleading information. You may not use this website to commit any criminal or immoral act.

1.5 Save as stated herein all information, goods & services provided on this website are provided “As Is” & neither we, nor any third party that we have used to provide content for this website, provides any representation, warranty (whether express or implied), term, condition, or guarantee as to the accuracy, timeliness, performance, completeness, suitability, merchantability of the information & materials found or offered on this website or that such information & materials shall be suitable for any particular purpose.

1.6 You acknowledge & agree that the information which we supply to you may contain inaccuracies or errors & in particular we expressly exclude liability to you howsoever arising for any such inaccuracies or errors in the materials & information to the fullest extent permitted by law.

1.7 Your use of any information or materials on this website shall be entirely at your own risk, for which we shall not be liable. In particular without limitation to the foregoing you agree that we will not be liable to you for any consequential loss, damages, costs, expenses, or other claims that you may incur arising out of your use of the information & materials.

We will not be liable to you howsoever for any interruption in your system, computer viruses, or communication failures.

Your reproduction of the contents of this website or use of the University or OBEL name & logo is strictly prohibited.

1.12 This website contains material which is owned by, or licensed to us by third parties. This material includes, but is not limited to, software, the design, layout, look, appearance & graphics of the website. Therefore reproduction of any of the foregoing is also strictly prohibited.

1.13 All trademarks, logos & names reproduced in this website, which are not the property of, or licensed to the University, OBEL or the operator, are acknowledged on the website.

1.14 Unauthorised use of this website may give rise to a claim for damages &/or constitute a criminal offence.

1.16 You may not create a link to this website from another website or document without the Brookes’ prior consent.

1.17 This website is operated by us in the United Kingdom & we make no representation that that the information or materials provided on this website is appropriate or legal in other locations. Your use of this website & any dispute arising out of your use of this website is subject to the laws of England & Wales & you agree that it shall be determined solely by the exclusive jurisdiction of the courts of England & Wales.

 

Section 2 Online Payment

You agree that your purchase from the Online Shop is subject to the following additional terms & conditions:

2.1 Payments will normally be completed within 2 Working Days. However completion of your payment may take longer particularly where you bank or credit or Pay Pal provider delays the transaction.

2.2 The Online Shop is hosted on behalf of the Brookes by WPM Education Limited which owns the copyright to the software & their name & logo incorporated herein.

2.3 For security & fraud prevention, the online payments which you make are remotely handled (including checking your card details) by Realex (http://www.realexpayments.com). Consequently we neither collect your card details ourselves, nor have access to them. You agree to abide by any terms & conditions appearing on the Realex website.

2.4 Where you have inputted personal information into this website Brookes will handle such information in accordance with the Data Protection Act 1998 & Brookes will ensure that the information is used for no other purpose & shall not be disclosed to any third party.

2.5 Each order that you make shall be an offer by you to purchase goods, services or conference facilities subject to these terms & conditions. We are entitled to reject any order (at our absolute discretion) & will notify you of any such rejection.

2.6 You must make payment by credit or debit card in advance of delivery. The following major credit cards & debit cards are accepted:

Unfortunately the Brookes does not accept American Express Cards or Diners Club Cards

2.7 It is your responsibility to ensure that all details of your order are complete & accurate. All prices are in UK pounds sterling. This may mean that conversion of your currency to UK sterling may be subject to exchange rate fluctuations at the prevailing rate set by your card issuer.

2.8 Payment will be immediately debited from your card account at the time you enter your card details on the secure payment page.

2.9 While we will take all appropriate technical & organisational measures to keep your personal & financial details secure, unless we are found to have been negligent we do not accept liability for any losses due to the unauthorised access by any person of any information provided to us by you.

2.10 In particular the Brookes accepts no liability for a payment not reaching the correct Brookes account due to inaccurate card details or personal information. Furthermore we do not accept liability where payment is refused by your bank or debit/credit card provider & Brookes is under no obligation to bring this to your attention.

2.11 Brookes will only make refunds (if applicable) to the original credit/debit card account used for the original transaction.

 

Section 3 Purchase of Goods

You agree that your purchase from the Online Shop of Goods shall be subject to the following additional terms & conditions:

3.1 The “Delivery Address” shall mean the address you stated for delivery of your Goods when you placed your order & “Goods” means the physical items purchased by you.

3.2 For United Kingdom Customers delivery will be by first class post or by courier (at the Customer’s option) at the cost set out on the Online Shop Order page. You must sign for  Goods upon delivery or Collection. In the absence of your signature, you may be required to collect the Goods from your local post office or courier depot at your own expense. Any date specified by Brookes for delivery/collection of your Goods shall be an estimate only & delivery will be within a reasonable time. We shall not be liable to you where our failure or delay in delivery is caused by a third party (including delay or failure to deliver caused by the UK Post Office or courier) or where arises from industrial action, fire, flood or act of god, explosion, accident or stoppage  or any other event which is beyond our reasonable control.

3.3 The price for the Goods will be displayed on the Brookes Online Shop. When placing your order on the Online Shop you must make all payments in advance, under the contract of sale, without any deduction. 

3.4 Postage, transportation, courier, packing & insurance shall be charged in addition to the price of the Goods & will vary according to your delivery address, weight & size of the Goods ordered, & the method of delivery preferred. Our usual charges for delivery are set out on our Online Shop Order page & information on postage, courier costs & packaging will be provided when you make your order.

3.5 From the time of delivery/collection the Goods are at your own risk. However you will not receive title to the Goods until we have received full cleared payment of the purchase price.

3.6 If you do not accept delivery of the Goods when we have notified you that they are ready for delivery or collection or we cannot deliver the Goods to you on time because you have provided inaccurate/insufficient information then the risk in the Goods will pass to you & the Goods will be deemed to have been delivered. In such circumstances we may store the Goods until delivery/collection by you but you will be liable for all costs & expenses arising from such storage.

3.7 All Goods are supplied by us with an unconditional 7 day money back guarantee in accordance with your rights under the Consumer Protection (Distance Selling) Regulations 2000. In order to return Goods under this money back guarantee, you must email us or write to us at the address below within 7 working days of delivery of the Goods. In addition you must arrange & pay for the cost of returning the Goods to us. We will refund the sums paid for the Goods delivered to you as soon as possible, but in any event within 30 days of you giving written notice to us of your intention to return the Goods.

3.8 If Goods are found to be faulty or damaged upon delivery or not of satisfactory quality, please contact us at the email address or postal address below within seven working days of receipt of the materials. We will, at our sole option, deliver replacement Goods or refund the price paid.

If you wish to cancel an order for any other reason please write or email us. Generally speaking if we have not dispatched the Goods we can stop the order. However if we have already dispatched the materials in good condition we will ask you to return the materials at your cost but no further charge will be made for materials received in good condition.

3.9 Subject to the terms & conditions herein the Goods will be of satisfactory quality (as defined in the Sale of Goods Act 1979 as updated) & we will not be liable for a breach of this provision unless:

3.9.1 You have given us written notice of the defect to us & if the defect is as a result of damage whilst in transportation you have notified in writing the carrier within fourteen (14) days of the date that you discovered or ought to have discovered the defect; &

3.9.2 We are given a reasonable opportunity after receiving the written notice from you to examine the goods, & if we ask you to do so, you have returned the Goods to  us at your own cost so that we can examine the Goods to ascertain whether it is defective.

3.10 Further more we will not be in breach of Condition 1.9 where you make further use of the goods after giving us notice. or the defect arises because you have failed to follow instructions as to the storage, installation, commissioning, use or maintenance of the Goods or (if there are none) or follow good trade practice or you have altered or repaired the Goods without our consent.

3.11 Save with respect to conditions implied by Section 12 of the Sale of Goods Act 1979 all other warranties, conditions & terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this Agreement. Furthermore our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise arising in connection with the performance or contemplated performance of the Agreement will be limited to the price of the goods sold to you. Furthermore we will not be liable to you for loss of profit, loss of business or depletion of goodwill nor for any indirect or consequential liability, loss or damage which arises out of or in connection with this Agreement.

 

Section 4 Attendance at Graduation Ceremonies and purchase of Replacement Certificates

You agree that your purchase from the Online Shop of tickets for University graduation ceremonies and Replacement Certificates shall be subject to the following additional terms & conditions (and the University process and regulations referred to therein) :

 4.1 Graduation Purchases

4.1.1 Eligibility

In order to be eligible to attend a graduation ceremony, you must be awarded by the deadline date advised on your PIP registration page. You should check the results tab of your PIP to confirm that your award has been conferred.

You will not be eligible to attend a graduation ceremony if you have outstanding debts to the University.

4.1.2 Refunds

You will be entitled to a full refund on the price of your graduation package and additional tickets if you cancel before 20 April 2012 (June ceremonies) or before 5 August 2012 (September ceremonies).  Tickets are non-refundable for cancellations made after the relevant date, unless the cancellation has been made due to academic failure.

4.2 Certificate Purchases

4.2.1 Eligibility

By purchasing a certificate re-issue you are agreeing to the Regulations for reissue of lost, damaged or destroyed certificate

Certificates can only be reissued for awards conferred by Oxford Brookes University from 1992 onwards.  Please refer to our website at www.brookes.ac.uk/go/certificates for information on awards made before this time.

4.2.2 Refunds

If we are unable to provide you with the service provided, you will be entitled to a full refund. In all other cases, payment is non-refundable.

Section 5 University Short Courses

Following your booking as a delegate on a University Short Course using the Faculty website you agree to abide by any regulations, processes or conditions appearing on such website and on the Faculty website and the terms and conditions of this On-line Shop (including Sections 1 to 5):

 

5.1 Faculty of Technology, Design and Environment

5.1.1 Symposium: Architecture “Live Projects” Pedagogy International Symposium 2012

The programme for the Symposium and relevant details (including name and address of the Course administrator, Programme, Course Fee etc) are found at the following faculty website:

However delegates must book a place on the Symposium by making payment on this On-line Shop in accordance with these terms and conditions. All other relevant details appear on the Faculty website.

Delegates should note that they will be able to book a place on the Symposium using this On-line Shop up to Thursday 10th May 2012 after which they must contact the Course Administrator (details on the Faculty website) and pay by cheque or credit/debit card (where accepted).

Delegates should note that they will be given a full refund for cancellations received by the Course Administrator where received in writing up to 14 days prior to the Symposium after which the full course fee will be charged.

Non-arrivals will also be charged the full course fee. However so long as their personal details and any requirements are providing advance in writing substitute delegates are welcome at no additional charge.

The University reserves its right to alter the contents, location and speakers of the Symposium without notice to delegates.

5.2 Faculty of Technology, Design and Environment:Short Courses in the School of Arts.


5.2.1 Delegates booking on the following University School of Arts Short Courses agree to the terms and conditions of the Faculty website located at www.brookes.ac.uk/arts/shortcourses, the terms and conditions of this On-line Shop (including Sections 1 to 5) and the specific additional booking conditions set out in Section 5.2.3 below.

5.2.3 The following additional booking conditions shall apply to bookings by delegates on the above School of Arts Short Courses:


Delegates should note that they will be able to book a place using this On-line Shop up to 14 daysprior to the start date of each short course set out on the Faculty website,after which they must contact the Course Administrator (details on the Faculty website) and pay by cheque or credit/debit card (where accepted).


Delegates should note that they will be given a full refund for cancellations received by the Course Administrator where received in writing up to 14 days prior to the Short Course after which the full course fee will be charged minus a £30 administration fee. No refunds will be given for cancellations received less than 14 days prior to the start of each course.


Non-arrivals will also be charged the full course fee. However so long as their personal details and any requirements are providing in advance in writing substitute delegates are welcome at no additional charge.


The University reserves its right to alter the content, location and speakers of each Short Course without notice to delegates.
